Justices Helen Morenikeji Ogunwumiju, Abubakar Dattijo Yahaya, Philemona Ekpe, Suleiman Hussain and Ibrahim Shata Bdliya has lambasted Justice Abang Okon for proceeding in the case involving Governor Okezie Ikpeazu when the Judgement he gave on the 27th of June had already been Appealed .
The Five Member Panel of Appeal Court Justices ruled that Justice Okon Abang engaged in somersaults, standing the law on its head, that he was impertinent and disrespectful to the Court of Appea over his actions.
Delivering Judgement on the Appeal by Governor Okezie Ikpeazu,the Appeal Court ruled that since the Abia State board of Internal revenue has stated that his tax receiptes were not forged,then the Governor cannot be chased out of office over the allegations.
There were about 6 appeals, the 4th one has just been delivered. PDP vs Obasi Ubah and Chukwuemeka Ubah.
The court granted the appealed and cost of 100, 000 awarded in favour of PDP.
The 3rd appeal was between Ikpeazu vs Chukwuemeka Obasi Ubah, PDP, INEC and the Appeal Court gave judgement in favour of Ikpeazu and awarded a cost of 100, 000 in his favour.
The second appeal judgement was Friday Nwosu v Ogah, Ikpeazu, PDP, and INEC.
Court dismissed the appeal and awarded 100,000 in favour of the defendants.
The 1st appeal judgement was the jurisdiction of the Federal High Court Abuja to sit on the stay of execution when the appeal has been entered at the Appeal Court and record of proceedings transmitted to the appellate court.
The Appeal Court blasted Justice Okon Abang to have sat on a case before a higher court.
THe lead judge said, “Justice Okon Abang ‘deliberately stood the law on its head’ by justifying his jurisdiction to hear the motion when appeal has been entered.
