Contrary to the claims by the authorities of the Nigerian police Force that it has returned the criminal case file of self acclaimed General Superintendent of Assemblies of God Nigeria that was sacked by the leadership of the church Rev Paul Emeka to the federal ministry of Justice for prosecution,the Director of Public Prosecution of the Federation, Mohammed Etsu is yet to received the case file.
The Criminal Case File with Charge No:CR/1081/2015 COP VS REV PROFESSOR PAUL EMEKA had been fully Investigated by the Inspector General Of Police Monitoring Unit and the accused Rev Paul Emeka allegedly confessed during Investigation that the Purported Professorial Certificate from the University Of Derby in England was indeed a Forged One.
The Current Commissioner Of Police in Ebonyi State CP Peace Ibekwe Abdallah who was a Former Commissioner Of Police IG Monitoring Unit headed the Team that Investigated the Forgery Case and sources at the IG Monitoring confirmed that the accused confessed to the crime and even wrote it boldy on a piece of Paper”I Rev Paul Emeka Forged the Said Proffesorial Certificate” which is together with the case File.
Other Members of the Team that took part in the Investigation Included CSP Tapida Bako,DSP(Barr)Victor C Nwadike and Inspector Isaac Fyneboy
Sources at the Legal Department of the Nigerian Police Force in Abuja revealed that part of the recommendation of the Former Commissioner Of Police Legal Mr. Nwodibo Ekechukwu was for the Police to charge the accused to court for Forgery.
A Source at the Nigerian Police Force Headquarters in Abuja clearly stated that the Former Inspector General Of Police Mr Solomon Arase compromised in the case which gave a lot of Senior Officers the go ahead approval to treat the case with Disdain.
When Contacted,the Head of the Team that carried out the Investigation and a Current Commisioner Of Police in Ebonyi State CP Peace Ibekwe stated that the Police as an Institution is headed by the Commissioner Of Police and that nothing happens without the Knowledge of the Inspector General Of Police.
“I am no longer competent to Speak on the matter again,because i have seized to occupy the Office of the Commissioner Of Police IGP Monitoring Unit” She told our Correspondent on Telephone
It will be recalled that the Attorney General Of the Federation and Minister Of Justice Mr Abubakar Malamion the 30th of August took over the prosecution of the Forgery case against Rev Paul Emeka for the Interest of Justice from the Incorporated Trustees of the Assemblies Of God Nigeria.
The immediate past Director of Public Prosecution of the Federation, DPP Mr. Mohammed Saidu Diri in a letter dated 18 June, 2016 addressed to the Inspector General of Police,IGP through the Commissioner of Police IG monitoring unit requested the police to handover the original case file with charge No. CR/1081/2015 COP Vs REV. PROFFESSOR PAUL EMEKA back to the minister of Justice and the Attorney of the Federation Abubakar Malami,SAN for Prosecution.
At the last adjourned date of the matter on Monday 19th September 2016 the DPP failed to send a Legal representative because of the inability of the legal Department of the Nigerian police Force and the Commissioner of Police incharge of IGP monitoring Unit who investigated the matter to produce the case file.
It was learnt that even the letter sent by the former DPP requesting for the case file had been kept under the carpet somewhere.
Sources close to the New Director Of Public Prosecutions Of The Federation Mr Mohammed Etsu has confirmed that the Police are yet to Forward the Original Case File to the DPP
Efforts to contact the Director of Public Prosecution of the Federation, DPP Mr. Mohammed Etsu proved abortive as his line was not going through.
As of the time of filling in this report, the case file is in custody of a Chief Sup of police,CSP, who investigated the matter at the force Headquarters in Abuja.
The Upper Area Court had on Monday adjourned the case till Friday 23rd of September 2016 in order to hear from the Attorney General of the Federation before ruling on the Application for Stay of Proceeding brought by Counsel to the accused Barr J.U Ajii.
But a Source at the Ministry of Justice revealed that since the AGF has taken over the Prosecution of the case,all that had happened at the Upper Area Court are now null and void .
The Source further stated that once the Attorney General gets the Original Case File from the Police,the AGF can reinstitute the matter at the Federal High Court
