… Promises to Make Them Have A Date With The Law
In a move hailed as a victory for constitutional democracy, the Rivers State House of Assembly has commended the recent judgment of the Federal High Court, Abuja Division, which restricts the Rivers State Government from withdrawing funds from the Consolidated Revenue Fund until the 2024 Appropriation Bill is presented to the Assembly. This development occurred on Monday during the Assembly’s 65th Legislative Sitting of the Second Session.
The commendation was led by Hon. Major Jack, Leader of the House, who presented the judgment as a critical statement under the Assembly’s “Statement by the Leader” segment. The House received and adopted the document as a working tool, with members expressing strong support for the court’s decision, calling it a step forward for constitutional governance.
The issue originated in July when the Assembly raised concerns over Governor Siminialayi Fubara’s continued spending from the state fund without presenting the 2024 Appropriation Bill. This situation prompted the Assembly to formally request a halt to state expenditures under Section 122 of the 1999 Constitution. Subsequently, the House, under the leadership of Speaker Rt. Hon. Martin Chike Amaewhule, filed a lawsuit in the Federal High Court, questioning the governor’s legal authority to expend state funds without legislative approval.
In its ruling, the court sided with the Assembly, directing the Central Bank of Nigeria, the Accountant-General of the Federation, and several banks to halt any withdrawals by the Rivers State Government until the budget is properly presented.
Speaker Amaewhule expressed firm support for the court’s decision, stating that the governor’s actions since July have violated constitutional requirements. He noted, “Governor Fubara has been spending state funds without legislative approval, and despite this court ruling, he continues to circumvent the law through the aid of certain officials acting as commissioners. They will eventually be held accountable.”
The Speaker also commended House members for their dedication to protecting democratic principles and warned that anyone undermining the constitution would face legal consequences. He concluded by describing the judgment as a “landmark decision,” underscoring the illegality of unapproved state spending.
