Sanusi Secures Major Victory as Appeal Court Orders Rehearing in Kano Emirate Dispute

In the case involving Alhaji Nasir Ado Bayero and the contested Kano Emirate, the Court of Appeal in Abuja has mandated a new hearing.

In a ruling on Friday, the Appellate Court ruled that Bayero was not given a fair hearing because of the poor way a Kano High Court handled the case against him.

The lead judgment’s author, Justice Mohammed Mustapha, said that Bayero was treated unfairly by the Kano High Court since it proceeded without giving him a hearing notice so he could make his case.

Justice Mustapha ruled that the way the proceedings against Bayero were handled amounted to a farce of justice and that all legal tribunals must guarantee justice for all parties by providing them with equal opportunities.

In particular, the Appellate Court ruled that Bayero should have received a hearing notice so that he could air his complaints prior to the issuance of the decision against him, which it characterized as a poor arrangement.

In order to ensure a prompt resolution, the Court of Appeal ordered that the matter be sent to the Chief Judge of the Kano State High Court for reassignment to another judge.

In the appeal that Ahaji Ado Bayero filed, Justice Mustapha did not impose costs on the respondents.
