Court to Hear Suit Seeking Refund of N140bn to FG Over OVH Energy Deal

A High Court of the Federal Capital Territory (FCT) has admitted for hearing a suit seeking the refund of ₦140.5 billion allegedly linked to the Nigerian National Petroleum Company Limited (NNPCL)’s acquisition of OVH Energy.

The case, marked CV/3104/2025, was filed by the Incorporated Trustees of Legal Defence Against Injustice Initiative as a public interest litigation.

Listed as respondents are NNPCL’s Chief Financial Officer and former Executive Vice President, Downstream, Mr. Dapo Segun, the Economic and Financial Crimes Commission (EFCC), and the Attorney-General of the Federation (AGF).

Through its lead counsel, Festus Ugo, the group is asking the court to determine whether Mr. Segun should be held personally liable under Section 15 (5) of the 1999 Constitution (as amended) to account for and refund:

  • $325.09 million (₦140.559bn) allegedly paid by NNPCL for OVH Energy’s acquisition.
  • ₦5 trillion reportedly paid under his watch for the rehabilitation of the Port Harcourt and Warri refineries.

The plaintiff is seeking several orders, including:

  • A declaration compelling the 1st defendant to refund the sums to the FG through the EFCC and AGF.
  • An order directing the EFCC and AGF to prosecute him over his roles in the OVH acquisition and refinery rehabilitation.
  • A perpetual injunction barring him from holding public office.

In a separate ex parte motion, the group urged the court to suspend Segun from office as NNPCL CFO pending the case’s outcome. It is also seeking an order compelling him to declare under oath details of all companies, directorships, assets, and bank accounts (domestic and foreign) linked to him since 2019.

The suit comes in the wake of EFCC’s recent disclosure that it had recovered funds allegedly diverted by contractors and senior NNPCL officials.

The matter is yet to be assigned a date for hearing.
