The Federal High Court in Abuja has dismissed a suit seeking the removal of David Mark and Rauf Aregbesola as National Chairman and National Secretary of the African Democratic Congress respectively.
Justice Joyce Abdulmalik dismissed the suit on Friday on the grounds that the matter concerns the internal affairs of a political party, over which the court has no jurisdiction.
Delivering judgment, the judge stated that membership and leadership within a political party are voluntary, noting that political parties operate as voluntary associations without compulsion.
Justice Abdulmalik further held that members who are dissatisfied with issues within their party should explore the party’s internal mechanisms for resolving disputes or choose to leave and join another political party.
She maintained that matters relating to party membership and leadership are not justiciable, stressing that courts cannot exercise jurisdiction over such issues.
