“The learned Justices of the Appeal Court erred in Law when they held that the Tribunal stated the position of the Law and there was no provision or guidlines in the Electoral Act that empowers the Returning Officer to cancel election or annul an Election Results “
Otti prayed the Court to set aside the judgement of the Appeal Court on the two issues raised above.

The reason behind the Cross Appeal Filed by Alex Otti may summarily be said to have come up from the Issue 14 bordering on wether or not the Returning Officer For Abia State governorship election Prof Benjamin Ozurumba had powers to annul an Election Results that had already been declared in various Units, Wards and Local Government Areas.
