The General Council of Assemblies of God Nigeria has asked the Supreme Court to Dismiss the Appeal filed by the Suspended,Dismissed and Disfellowshipped former General Superintendent Rev Dr Paul Emeka against the Judgement of Justice Emmanuel Agim of the Enugu Division of the Court of Appeal which on April 14th 2015 upheld the decision of the General Committee of the Church taken on March 6th 2014 .
Assemblies of God in a response to the Brief of Arguement filed by Rev Dr Paul Emeka prayed the Supreme Court to uphold the Judgement of Justice Emmanuel Agim led Panel of Appeal Court Justices which on the 14th day of April 2015 upheld the March 6th Suspension,Dismissal and Ex-communication of the former General Superintendent of the Church
“We submit most respectfully that the decisions of the court below on the salient issues in this appeal are faultless. Most respectfully, this appeal does not deserve success. We urge that it be dismissed for want of merit.
Paul Emeka had after Appealing the Judgement of the Enugu Division of the Court of Appeal on April 2015 failed to file his brief or arguement until January 19th 2016 when Justice Walter Samuel Nkanu ordered that he file his brief of Arguement before 5th of February 2016
Paul Emeka in his brief of Arguement dated 4th February 2016 Prayed the Supreme Court to set aside the Judgement of the Enugu Division of the Court of Appeal on grounds that the court miscarried Justice
“We Urge this court to set aside the Judgement of the Court of Appeal and Affirm the Judgement of the High Court”
It will be recalled that Rev Dr Paul Emeka was Suspended,Dismissed and Disfellowshipped from Assemblies of God Nigeria for violating Article Twelve of the Constitution and Bye-Laws of Assemblies of God which frowned at anybody taken the Church to Court
The Supreme Court is yet to fix a date for hearing..
