Judge Refuses To Release Ojukaye Flag Amachree From Prison

The Magistrate court sitting in Port Harcourt has struck out an application by inspector General of police, SOLOMON ARASE seeking to withdraw murder charges against the former caretaker committee chairman of Asari-Toru Local Government Area and chieftain of APC, OJUKAYE FLAG AMACHREE.

At the resumed hearing yestertoday, prosecution council had tendered a letter from inspector General of Police, SOLOMON ARASE ordering the withdrawal of the case for review of the charges.
In the letter, the IGP said the matter was not properly investigated before charging the suspect to court and thereby should before withdraw for review for the sake of justice.

In his ruling, the Chief Magistrate ISRAEL AGBESO said the court can not grant the request of the IGP following the report of the Department of Public Prosecution date 22nd of April 2016 which he said has indicated a case of murder established against the accused.
AGBESO also informed prosecution counsels that the advised of the DPP shows that OJUKAYE FLAG AMACHREE should face his trail which he said made it impossible to grant the request of the IGP.
The chief magistrate however struck out the murder before him against the accused following the fact that he has no jurisdiction to hear it .
The trail judge, ISRAEL AGBESO ordered that OJUKAYE FLAG AMACHREE should be send back to prison custody pending on when the matter will be file in high court.
Speaking to journalist outside the court room, led counsel to the accused, HENRY ODILI expressed dissatisfaction over the decision of the trail judge to ordered that his client be sent back to prison after he has struck out the matter before him.
ODILI said he would take up all legal means to ensure that his client is released from the prison custody.
On his part, TUBOTAMUNO DICK who is the Lawyer representing the complainant, NDOKIYERI SOBEREKON said the ruling of the court was in order.

The court was flooded with supporters of All Progressive Congress in the state as well as the family members of the accused person as security was also befit up around the area.
