A lawyer, Mr Mohammed Ibrahim, has asked the Federal High Court in Abuja, for an order stopping the National Assembly from further mandating, the Comptroller General of Custom, Col. Hameed Ali (retd.), to wear the Customs’ uniform.
The plaintiff argued in the suit filed on Tuesday and marked FHC/ABJ/CS/207/2017 that Ali, not being a commissioned officer of the Customs, could not be forced to wear the uniform of the Service in the discharge of his duties as the CGC.
He also wants the court to hold that compelling Ali to wear the service’s uniform was not part of the oversight functions of the National Assembly.
The plaintiff described himself as a Nigerian, taxpayer and a legal practitioner with speciality in “human rights enforcement, customs, excise and maritime matters, corporate and business law.
He sued as the first to the fifth defendants, Ali, the Nigeria Customs Service, the National Assembly, the Senate and the Attorney-General of the Federation.
In an affidavit deposed to on behalf of the plaintiff and filed in support of the suit, the deponent, Mr John Kyauta, stated, “The first defendant (Ali) was appointed as Comptroller General of Custom by the President of the Federal Republic of Nigeria in exercise of his constitutional power.
