The Appeal Court, Abuja Division yesterday has determined Dr Ogah’s appeal in which he sought the intervention of the appellate court to set aside the High Court Ruling that authenticated Chief Ikechi Emenike as APC governorship for Abia State in 2019 election.
Dr Uche Ogah had sought to be joined as party to the suit in which Chief Emenike cleverly sued only APC and INEC excluding Dr Ogah who was the validly elected candidate of APC in their primaries. The FCT High court had refused to have Dr Ogah join in the suit and all attempt to have his application that was wrongly struck out to be relisted was rejected and the court strangely held that the striking out order amounted to a “dismissal”. It was this ruling that prompted Dr Ogah to proceed to the appellate court on grounds of denial of fair hearing and jurisdiction.
Recall that APC also appealed against this same ruling and got the ruling set aside last Monday by the appellate court on grounds of lack of jurisdiction.
For effect, the same appellate court yesterday held that the orchestrated plan by Chief Emenike not have joined Chief Ogah in the said suit at the lower court and for the lower court to have agreed to such a process was not only wrong but manipulative, and the appeal court went ahead to set aside the said ruling and held that DR UCHE OGAH REMAINS THE AUTHENTIC AND VALIDLY ELECTED GOVERNORSHIP CANDIDATE OF APC IN ABIA STATE.
The name of Dr Ogah is already with INEC as the Abia State governorship candidate for 2019 general election.
Meanwhile the President of the country President Muhammadu Buhari alongside with the highest leadership of the ruling party, APC had handed over the governorship flag of the party to Dr Uche Ogah in Aba stadium yesterday in the presence of the mammoth crowd of Abians that trooped to the stadium to witness the flag off of the presidential campaign of President Muhammadu Buhari GCFR.
In handing over the flag to Dr Uche Ogah OON, Mr President Mohammadu Buhari prophetically said “I present to you, your next governor”.
