An Abia High Court sitting in Umuahia on July 13, 2022 struck out the case filed by one Ebyson Kalu Ebei, asking it to restrain the PDP from using its three-man delegates list for the conduct of primary elections.
The case on Suit No. HUK/23/2022 BETWEEN KALU EBYSON EBEI v RT. HON. ALWELL OKERE ASIFORO & 2 OTHERS (Barr. David Iro and PDP) had in the originating summons among others, asked the court to restrain Rt. Hon. Alwell Asiforo Okere, Barr. David Iro, the PDP and their Agents, Privies, Servants and anyone acting on their behalf from using the three-man delegates list for any election for the PDP until a valid one is conducted.
Curiously, when the case came up for hearing on July 13, 2022, the claimant and his counsel were absent in court and the suit was struck out which brought to an end the unsubstantiated allegation that the three-man delegates election was not conducted in Abia State.
The judgement is a victory for PDP, Abia State and democracy because it has finally settled the matter concerning the Abia three-man delegates and the unnecessary cacophony that followed it.
As we continue our final descent to the great battle of 2023, the Party reiterates its commitment to the values that define Abia, one of which is the strict adherence to due process as this judgement in favour of the PDP has clearly demonstrated.
We call on Ndi Abia to continue to have confidence in the judiciary as the last hope of the common man as well as continue to support the PDP government of Dr. Okezie Victor Ikpeazu which is bent on protecting the independence of the Judiciary as an arm of government to protect the rule of law at all times.
