Appeal court upholds Diri’s reelection as Bayelsa governor, dismisses APC’s suit

The Bayelsa Governorship Election Tribunal’s ruling, which had maintained Bayelsa State Governor Douye Diri’s reelection on November 11, 2023, was upheld by the Abuja Division of the Court of Appeal on Thursday.

In a unanimous ruling, the appellate court’s three-member panel denied an appeal that attempted to vacate and dismiss the Tribunal’s ruling.

Remember that on May 27, the three-member tribunal presided over by Justice Adekunle Adeleye rejected the APC’s and its candidate’s suit challenging Governor Diri’s reelection on the grounds that it lacked merit.

The tribunal determined that the petitioners had not produced any reliable evidence to support any of the claims they made regarding the results of the gubernatorial election.

Timipre Sylva, the All Progressives Congress’s nominee for governor, filed the instant appeal.

The panel determined that the appeal lacked merit and was therefore subject to dismissal since it was incompetent and constituted an abuse of the legal system.

The panel clarified that no substantial evidence based on the law was available to overturn the previous ruling made by the Bayelsa State Governorship Election Petition Tribunal.
