The Independent National Electoral Commission (INEC) has announced its decision to maintain neutrality and uphold judicial directives following the recent judgment of the Court of Appeal in the leadership dispute within the African Democratic Congress (ADC).

In a press release issued on April 1, 2026, the electoral body confirmed receiving conflicting legal communications regarding the recognition of Nafiu Bala Gombe as Acting National Chairman of the party. While one legal team urged INEC not to recognise Gombe due to an ongoing case at the Federal High Court, another demanded enforcement of the appellate court’s judgment in his favour.

The dispute stems from Appeal No. CA/ABJ/145/2026 between David Mark and Gombe, alongside other parties. The Court of Appeal, in its March 12, 2026 ruling, dismissed an interlocutory appeal filed by Mark and issued preservatory orders directing all parties to maintain the “status quo ante bellum” pending the determination of the substantive suit before the Federal High Court in Abuja.

INEC noted that the current National Working Committee (NWC) of the ADC, led by Mark, emerged after a National Executive Council meeting held on July 29, 2025. However, Gombe has contested this arrangement, insisting he never resigned and should automatically assume leadership following the resignation of the former chairman.

After reviewing all submissions and the court’s directives, the Commission resolved to:

  • Maintain the status quo as it existed before September 2, 2025, when the suit was filed.
  • Refrain from recognising any faction or taking actions that could prejudice the ongoing court proceedings.
  • Decline requests to install Gombe as Acting National Chairman pending the court’s final decision.
  • Suspend all engagements with both factions, including monitoring party meetings, congresses, or conventions.

Significantly, INEC also announced the removal of the names of the current NWC members led by Mark from its official portal. The Commission stated that this step aligns with the Court of Appeal’s directive to preserve the situation as it was before the dispute escalated.

INEC further reiterated its commitment to neutrality, impartiality, and strict compliance with judicial orders. It urged political parties and stakeholders to act responsibly to avoid disrupting preparations for the 2027 general elections.

The statement was signed by Mohammed Kudu Haruna, National Commissioner and Chairman of the Information and Voter Education Committee.
