Supreme Court Delivers Judgement On Assemblies Of God Crises

A Five Member Panel of Supreme Court Justices Presided Over by Justice Mary Odili  will today deliver Judgement in the leadership crises rocking the Assemblies of God Church Nigeria over the refusal over a Former General Superintendent of the Church Rev Paul Emeka to serve the Suspension meted on him by the General Commitee on the 6th Of March 2014.

The apex court had fixed today for judgement after Counsel to both parties adopted their various briefs of arguments on the 29th Of November 2016.

The Court of Appeal in Enugu had in April 2015 upheld the Suspension and Dismissal of the Former General Superintendent of the Assemblies of God Church, Paul Emeka, by the church.

In a lead judgment delivered  in Enugu Division of the Appeal Court by Justice Emmanuel Agim, the court held that it was not the fundamental right of any member to be the General Superintendent of the church.

The court voided the  application of embattled Rev Paul Emeka for the protection of his fundamental human rights as General Superintendent.

It said that there was no proper proof of service on the Assemblies Of God Nigeria and that the trial court Presided Over by Justice Anthony Onovo was wrong in deciding that there was proper service.

The court also overruled the order of an Enugu High Court that other members of the church that held various executive offices should vacate them.

It voided the order of the trial court which awarded N30 million against other members of the executive and in favour of Rev Emeka.

The court blamed the respondent for the crisis that had engulfed the church over the years, adding that the way Rev Paul Emeka approached the misunderstanding in the church heightened the crisis.

It will be recalled that Paul Emeka was suspended by the General Commitee of the  church for suing the Church to Court

Property worth millions of naira were destroyed in the course of the crisis that most times resulted in free for all among church members.

No fewer than three cars were burnt at the National secretariat in Enugu in November 2014 during one of the fracas by the various factions.

Rev Paul Emeka also led armed thugs to Forcefully take over the National Secretariat of the Church located at Independence Layout Enugu.

The Judgement of the Supreme Court will put an end to claim and counter Claims.
