The Court of Appeal Owerri felt the heat between the lawyers of Dr. Alex Otti and that of the three respondent (Gov. Okezie Ikpeazu, PDP and INEC)
Dr. Alex Otti was represented by Olugimi (SAN), Akeredulo (SAN), Chris Uche(SAN) and many others, while Gov. Okezie Ikpeazu was represented by Olanipukun (SAN), Ananaba (SAN) and lot more.
All tese counsels appeared before Hon. Justice Oyebisi Folayemi Onoleye led Appeal panel. This panel as AFN earlier reported is been challenged by Abia State PDP who desire they should be disbanded because they’ll came from one State (Lagos State).
After all introduction of lawyers from both side, the legal fire work started. Olugimi (SAN) took his time to state all the issues his client(Dr. Alex Otti) has with the decision of the lower tribunal which includes :-
The Card Reader not playing prominent place in their decision, the card reader proved that the number of vote exceeded the number of accredited voters.
He also drew the attention of the panel to fact that the returning officer had earlier cancelled the elections in Obingwa, Isiala Ngwa North and Ugwunago LGs respectively and that it is only a competent court that can reverse that decision.
Olugimi concluded his argument by stating the failure of the tribunal which ruled that APGA participated in a rerun election which never happened. He emphasized that what held in Abia State was a supplementary election which did not cover the areas been contested by APGA.
Olanipukun (SAN) put up his show in defence of the respondents ,He stated that Dr. Alex Otti has no issue and that the matter should be dismissed.
