Legal Term ‘Subpoena’ Throws Rivers Tribunal Into A Roudy Sitting

The National Assembly Election petition Tribunal sitting in Apo,Abuja was today thrown into a roundy session when the Counsel to Barry Mpigi,candidate of the All Progressive Congress for Eleme/Oyibo/Tai Federal Constituency told the Tribunal Panel that they subpoena’d the the Chief Of Army to appear before the Tribunal and give Evidence on their role in the March 28th National Assembly Elections.

However Chief Barr.Okey Wali,counsel to the Member Representing Eleme/Oyibo/Tai Federal Constituency and candidate of the PDP Hon.Jacobson Mbina pleaded that the Tribunal give them more time to enable his team go through the APC candidates Subpoena,describing the appearance of some Nigerian Soldiers as an Ambush to the PDP/INEC.
However Counsel to Barry Mpigi Chief Barr.Fagbemi(SAN) argued that by law when a subpoena witness is called,he doesn’t have any bussiness by telling his opponents on the other bench who they are.
The Heat generated by the argument in favour and counter arguement forced the Tribunal to adjourn for 15minutes to enable it ru;e on whether or not the special witnesses can go ahead to testify.
The Tribunal while delivering Judgement held that there was nothing in the electoral act stopping the witnesses testifyng to what the saw during the March 28th 2015 National Assembly Elections.
Subsequently the Soldiers were admitted by the Tribunal to Testify
