Why Appeal Court struck out Appeal by 22 Sacked APC LGA Chairmen

Justice Theresa Orji Abosua of the Porharcourt division of the Court of Appeal yesterday struck out the Appeal Filed by the 22 Sacked APC Local Government Area Chairmen against the judgement of Retired Justice Lambo Akanbi of the Port Harcourt Federal High Court which cancelled the May 23rd Local Government election in Rivers State.

The Judge in her ruling yesterday said her panel cannot rule on the Appeal on its merit due to Administrative errors the panel discovered in the Appeal Filed by Augustine Ngo on behalf 21 others of his colleagues.

Although counsel to the Rivers State Government Barr Emma Aguma SAN who is also the commissioner for Justice and attorney General of the state prayed the Court to dismiss the Appeal, but Justice Theresa Orji Abosua said instead of Dismissing the Appeal, her panel will struck it out to enable the Appealants correct the errors and refile the Appeal within Seven days from Yesterday.

PUO REPORTS
Learnt that following the first ruling by the Court of Appeal, the sacked 22 APC Local Government Area Chairmen withdrawn the other Appeals to correct the same errors.

The errors PUO REPORTS gathered is coming as a result of the change of Administration in the Rivers State Government, since it was the Rivers State Government and the Rivers State Independent Electoral Commission under Rt Hon Rotimi Amaechi that conducted the May 23rd Local Government election in Rivers State.
