How Paul Emeka’s Attempt to Stop Trial over Certificate Forgery Failed

The Upper Area Court Sitting in Gudu the Federal Capital Territory yesterday adjourned for ruling for on the Application Stay of execution brought by the Suspended,Dismissed former General Superintendent of Assemblies of God Rev Dr Paul Emeka over the Order asking the Nigerian Police to arrest Him for Trial.

At the Resumed sitting of the Court yesterday,Counsel to Paul Emeka Barr J. U. Ajii asked the Court to stay proceeding because his client has exercised his right of Appeal at the Abuja High Court

”My Lord, the defendant has already exercised his right of Appeal of which parties have properly been served. The application is in view of the appeal in respect of the matter before the Hon. Court. We therefore urge Your Lordship to stay further proceedings of this matter pending the determination of the appeal”

But Counsel to the Incorporated Trustees of Assemblies of God Nigeria Barr. Ifeanyi Nweze opposed the application by Paul Emeka on grounds that his Appeal does not stop the Proceedings of the case in the Court

“We oppose the application on stay of proceedings. The fact that a party has gone on an appeal does not act as an automatic stay of proceedings. We frown that the suspect is not here today in court”

Paul Emeka continuously hinged on not being given fear hearing to stall the Trial at the Court

Justice Yusuf Kagarko after listening to parties in the matter,adjourned till May 5th 2016 for ruling on the Application by Paul Emeka

“We have to close this case because others are equally waiting for their turn. Case adjourned till the 5th of May, 2016.
